Abstract

The spread of fake news (hoaxes) that convince consumers to buy concert tickets online when the tickets are never available is a recurring crime mode in organizing international music concerts in Indonesia, as reflected in the Coldplay concert ticket fraud case that caused losses to hundreds of victims amounting to billions of rupiah. This article aims to analyze the legal regulations regarding the crime of spreading fake news that results in consumer losses in electronic transactions according to Indonesian positive law, and evaluate the consistency of its enforcement through three court decisions that are used as study material, namely the Decision of the Central Jakarta District Court Number 157 / Pid.B / 2024 / PN Jkt.Pst, the Decision of the Depok District Court Number 320 / Pid.B / 2023 / PN Dpk, and the Decision of the Supreme Court Number 3905 K / Pid.Sus / 2022. The results of the study show that Article 28 paragraph (1) in conjunction with Article 45A paragraph (1) of the Electronic Information and Transactions Law (ITE Law) is positioned as lex specialis against Article 378 of the Criminal Code (now Article 492 of Law Number 1 of 2023 concerning the National Criminal Code) for the act of spreading false news that is detrimental to consumers in electronic transactions, but its application in judicial practice is not yet consistent.
